KFX Marketplace, hosted at kfx-dev.com (“we”, “our”, “us”) is operated by KFX Development, based in the Republic of Serbia.

By creating an account on our website or using any of its functionalities, you agree to comply with these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, you must not use the website or any services connected to KFX Development.

We reserve the right to modify or update these Terms at any time, with or without prior notice. Continued use of our website or services after any such changes means you accept the revised Terms.

GLOSSARY

For the purposes of these Terms:  

• “We”, “Us”, “Our”, “Marketplace” refers to KFX Development (or KFX Marketplace).
• “User”, “You”, “Customer” refers to any individual accessing or using our website, creating an account, or interacting with our Marketplace.  
• “Services” refers to all features, content, and functionality offered by KFX Development, including but not limited to the marketplace resources, customer support, and more.  
• “Account” refers to a registered user profile on our website.  

ACCEPTANCE OF TERMS

By registering an account, accessing, or using any part of our website, you agree to these Terms and the Privacy Policy. Your continued use constitutes acceptance of all updates or amendments we may make in the future.

ACCOUNT MANAGEMENT AND TERMINATION

We reserve the right to suspend, restrict, or permanently delete any account, with or without prior notice, for any reason including (but not limited to):  

• Violation of these Terms or the Privacy Policy;
• Fraudulent, abusive, or malicious behavior;
• Inactivity or security-related concerns.  

Termination of an account does not entitle you to any form of compensation, reimbursement, or refund, regardless of any purchases made on our marketplace.

We also reserve the right to modify, disable, or terminate access to any or all of our services (or resources) at any time, without notice or liability.

We will not restrict access to active purchased resources or your customer account, unless you clearly violate our Terms or other rules.

COMMUNITY CONDUCT

By using our website or our support services, you agree to follow our Terms and other rules and maintain respectful behavior towards other customers/users and staff. Violation of these rules may result in temporary or permanent bans from our services, with no refund or compensation.

DATA PROTECTION

Read our Privacy Policy.

We do not share or disclose your personal information to any third party, except as required by law or when necessary to fulfill our legal obligations.

We follow industry standards for data encryption and protection. However, we are not liable for unauthorized access caused by third-party providers (such as hosting services) or malicious cyberattacks beyond our control.

SERVICE AVAILABILITY AND DISCLAIMER  

Our services and website are provided on an “as is” and “as available” basis. We make no guarantees about uptime, functionality, or performance.  

We reserve the right to restrict, suspend, or terminate access to our website, or any related features for any or all users at our sole discretion, without notice or compensation.

KFX Development & KFX Marketplace are not affiliated with, endorsed by, or in any way connected to Mojang AB, Microsoft Corporation, Mick Pty Ltd., PayPal Holdings Inc. or Discord, Inc. “Minecraft” and related assets are trademarks of Mojang AB/Microsoft Corporation. Most other content, branding, and materials created by us remain our intellectual property.

PAYMENTS AND REFUNDS

All payments and donations are handled securely by PayPal (PayPal Holdings, Inc.), our payment provider. By making a purchase or donation, you also agree to the PayPal Terms & Conditions and Privacy Policy.  

We do not have access to, store, or process your payment details — all payment information is managed by PayPal through secure systems.

All payments are final and non-refundable under any circumstances. Attempting to charge back or reverse a payment will result in your license being revoked in our customer database and all associated services. Your customer account may also get terminated without compensation.

We guarantee that the purchased resource will work as advertised at the time of purchase, unless stated otherwise. If that is proven to be false, our team should be able to resolve all issues within a reasonable amount of time. Resources may get discontinued or deactivated in the future, with or without notice, without compensation.

All future resource updates shall be provided free of charge for all existing customers.

Purchases do not grant immunity from moderation or enforcement actions.

The customer agrees to not redistribute purchased resources in any way, shape or form. Unauthorized sharing of the resource content (or a part of it) with anyone, online or offline, is a breach of our Terms and other rules, and a breach of our intellectual property. Doing so will result in your customer account will get terminated as per our Terms of Service.

All purchased resources are digital-only; no physical goods are shipped or delivered.

STANDARD EULA - RESOURCE PERMISSIONS AND LIMITATIONS

The Standard EULA applies to all products purchased from KFX Marketplace. Failure to comply with them can result in your license being revoked and/or account getting deleted, without refunds.

This is what you can do with products purchased on KFX Marketplace:

• Hosting: You may upload the resource to a secure and reliable server hosting of choice.
• Commercial use: You can make money using the product.
• Modification: You can make changes if you need to.
• Unlimited projects: You can use the product on unlimited projects (servers).

This is what you cannot do with products purchased on KFX Marketplace:

• Resale: You may not sell the product.
• Relicense: You may not relicense the product.
• Refunds: No refunds unless the product doesn't work as advertised. 
• Redistribution: You may not make the product accessible to anyone that did not purchase it.
• Attribution: You may not remove any attribution, credit, watermark or claim the product as your own.

LIMITATION OF LIABILITY  

To the fullest extent permitted by law, KFX Development, and its affiliates are not responsible for:  

• Any loss of data, profit, or account access;
• Unauthorized access caused by external attacks or technical issues;
• Service downtime or interruptions;
• Consequences arising from user misconduct or violations of these Terms.

By using our services, you acknowledge that participation is voluntary and that you assume all risks associated with your use of our website or game servers.

CHANGES TO TERMS

We may modify these Terms at any time without prior notice. Updated versions will be posted on this page, and continued use of our services after changes take effect constitutes acceptance of the revised Terms.
